Terms and Conditions of Service
Effective Date: [from 15 March 2015 through tomorrow] Applies to all services provided by Eco Home and Tree Care, LLC and/or Eclectic Enterprise, LLC under Arbitration.
1. Our Commitment
We approach every project with care, respect, and professionalism. Our team brings years of experience, specialized equipment, and ongoing training to deliver results that exceed expectations. We aim to build lasting relationships rooted in trust, transparency, and mutual appreciation.
2. Scope of Services
Services may include, but are not limited to:
- Tree and shrub care: pruning, removal, stump grinding, trimming
- Landscape projects: design, installation, grading, hardscaping
- Lawn and garden care: mowing, edging, aeration, dethatching, seeding, leaf mulching, weed removal
- Chemical applications: fertilizers, fungicides, moldicide, insect treatments, and termiticides.
- Surface cleaning: pressure washing of siding, fences, decks, sheds, sidewalks, driveways, pavers
- Painting and staining: wood surfaces, fences, decks, outdoor structures
- Snow removal: walk-behind blower clearing only; no shoveling or salting included
- Hauling and moving: debris removal, patio furniture relocation, equipment repositioning (additional charges apply)
All services are performed using professional-grade tools. Pricing reflects equipment wear, off-site maintenance, consumables, and training.
3. Payment Terms
- Payment is due upon completion unless otherwise agreed in writing
- Extended payment plans may be offered upon approval
- Late payments incur a 5 percent fee per billing cycle
- Returned checks will be charged back to the customer, plus a processing fee
- Discounts, rebates, and promotional pricing are voided by late or missed payments
- Non-payment may result in suspension or cancellation of future services
4. Site Safety and Responsibility
We treat your property with care. However, due to the nature of outdoor work:
- Minor lawn disturbance may occur during heavy equipment use
- Chemical treatments require adherence to post-treatment guidelines
- We are not responsible for pre-existing damage or unmarked underground utilities unless disclosed in advance
Customers requesting furniture or equipment relocation accept responsibility for incidental damage. A minimum deductible applies to any loss or damage. Claims exceeding twice the base deductible will be resolved through arbitration. If the first arbitration fails to reach agreement, a second process will be engaged. All employee insurance and bonding will be invoked before company-level coverage is accessed.
5. Equipment and Expertise
Our pricing reflects:
- Use of specialized machinery and tools
- Off-site cleaning, maintenance, and gear replacement
- Ongoing employee training and skill development
- Cross-functional expertise across service types
6. Scheduling and Weather
We strive to meet agreed timelines. Delays due to weather or safety concerns may occur. We will communicate promptly and reschedule as needed.
7. Permits and Access
Customers are responsible for securing necessary permits unless otherwise arranged. Clear access to work areas is required.
8. Cancellation and Rescheduling
Cancellations within 48 hours of scheduled service may incur a fee. Rescheduling is free with reasonable notice.
9. Customer Events and Appreciation
Customers may be invited to company-sponsored events, including office visits, maintenance area tours, or appreciation gatherings. Participation is voluntary and governed by standard safety and liability protocols.
10. Default Terms for Project Flexibility
To ensure project completion and quality, we reserve the right to:
- Adjust workflow and methods as needed
- Substitute materials or techniques when appropriate
- Communicate changes transparently and in good faith
These terms apply across all service categories, including but not limited to; tree care, landscaping, painting, lawn and garden maintenance, and snow removal.
